Denying as moot 65 MOTION for Summary Judgment with Supporting Brief filed by Julius Flagg. All other motions will remain pending. Counts 1, 2 and 3 are ordered severed from this cause of action and the Clerk is directed to open Counts 1, 2 and 3 as separate actions with new case numbers to be assigned. Each of these severed actions require new filing fees to be assessed, except that the Court will waive the assessment of a filing fee in each severed case that Plaintiff moves to voluntarily dismiss within forty five days of this order.
