ORDER: No later than Wednesday, May 12, 2010, at 12:00 noon Plaintiffs Steve Dudley and Beth Dudley shall file either: a motion for remand of this case to the Circuit Court of the Third Judicial Circuit, Madison County, Illinois, pursuant to 28 U.S.C . § 1447(c) by reason of a procedural defect in the removal of this case, to wit, the untimeliness of the removal under 28 U.S.C. § 1446(b), together with any other grounds for remand they may wish to assert; or a written consent to the removal.
