Filing 10 ORDER DISMISSING CASE: COUNT ONE fails to state a claim upon which relief may be granted, and thus is DISMISSED without prejudice to Plaintiff bringing this claim in state court. Defendants DAVIS, LOCHMANN, THROM and BERTELS are DISMISSED from this action without prejudice. IT IS FURTHER ORDERED that COUNT TWO fails to state a claim upon which relief may be granted and is DISMISSED with prejudice. Defendant HUNT is DISMISSED from this action with prejudice. Plaintiff is advised that this dis missal shall count as one of his three allotted strikes under the provisions of 28 U.S.C. § 1915(g). Plaintiffs obligation to pay the filing fee for this action was incurred at the time the action was filed, thus the filing fee of $350 remains due and payable. Signed by Judge Michael J.
