ORDER granting 46 Motion for Judgment on the Pleadings and Dismissing Case: For the reasons explained in the attached Order, the Court GRANTS Defendant Veath's motion for judgment on the pleadings (Doc. 46). Plaintiff's claims against De fendant Veath are DISMISSED with prejudice. ORDER appointing Attorney Steven M. Sherman for Eugenio Laso for the limited purpose of identifying the Unknown Lieutenant of the Transfer Bus. The Second Amended Complaint SHALL BE FILED WITHIN THREE MONTHS of the entry of this order. Failure to i dentify the Unknown Lieutenant of the Transfer Bus and file a Second Amended Complaint will result in the dismissal of the case. IT IS HEREBY ORDERED that COUNTS 1 and 2 of Plaintiffs complaint fail to state a constitutional claim upon which relief m ay be granted, and thus are DISMISSED without prejudice.
