ORDER REFERRING CASE to Magistrate Judge Philip M. Frazier. IT IS HEREBY ORDERED that COUNT TWO fails to state a claim upon which relief may be granted, and thus is DISMISSED without prejudice. Defendant HARDY is DISMISSED from this action without prejudice. Because the Court finds that Herreras claim of use of excessive force against Defendants Walters and Stout withstands screening under 28 U.S.C. § 1915A, it is hereby ORDERED that the Clerk of Court shall prepare for Defendants WALTERS and STOUT: (1) Form 5 (Notice of a Lawsuit and Request to Waive Service of a Summons), and (2) Form 6 (Waiver of Service of Summons).
