Filing 14 ORDER REFERRING CASE to Magistrate Judge Stephen C. Williams. IT IS HEREBY ORDERED that the Clerk shall add ALEXANDER COUNTY and SGT. LYERLA as Defendants in this case. IT IS FURTHER ORDERED that COUNT 2 is frivolous and thus is DISMISSED with preju dice. COUNTS 1, 4, and 5 fail to state claims upon which relief may be granted and thus are DISMISSED without prejudice. Defendants BOYD and ALEXANDER COUNTY are DISMISSED from this action with prejudice. Defendant UNKNOWN ARRESTING OFFICER is dis missed from this action without prejudice. COUNT 3 shall receive further consideration. The Clerk of Court shall prepare for Defendant LYERLA: (1) Form 5 (Notice of a Lawsuit and Request to Waive Service of a Summons), and (2) Form 6 (Waiver of Service of Summons).
