DEFENDANTS CHANDLER, DUSING, CALLAHAN, and FUNK are DISMISSED from the action without prejudice. IT IS FURTHER ORDERED that, should he wish to proceed on his claims in COUNT 4 and/or COUNT 6, Plaintiff shall file his First Amended Complaint with in 35 days of the entry of this order.
