ORDER : Plaintiff's complaint is DISMISSED for failure to state a claim upon which relief may be granted. COUNT 1 (Deliberate Indifference to Medical Needs) is DISMISSED without prejudice. COUNT 2 of the complaint (Conditions of Confinement) i s DISMISSED with prejudice. Should Plaintiff wish to proceed on his deliberate indifference claim in COUNT 1, he shall file his First Amended Complaint, stating any facts which may exist to support a claim of deliberate indifference to his medical c ondition after his "second" injury, and naming the individual Defendants directly responsible for the alleged deprivations in Count 1, within 35 days of the entry of this order. The Clerk is DIRECTED to mail Plaintiff a blank civil rights complaint form. (Action due by 2/27/2013). Signed by Judge Michael J. Reagan on 1/22/2013. (tjk)
