Filing 17 ORDER. On June 6, 2013, Antonia Togias (who was included as a plaintiff in a proposed amended complaint in this putative class action) filed a notice of dismissal pursuant to Federal Rule of Civil Procedure 41, so as to clarify that she is not a party to the case. As Togias notes, an Amended Complaint was filed on May 30, 2013 "with all references to Plaintiff Togias removed." Since an amended complaint supersedes any other pleading, Anderson v. Donahoe, 699 F.3d 989, 997 (7th Cir. 2012), and an amended complaint is the "operative document" in a case, Wisc. Interschol. Athletic Ass'n v. Gannett Co., Inc., 658 F.3d 614, 621 (7th Cir. 2011), and since Togias is not listed as a plaintiff in the Amended Complaint, there was no need for her to file a notice of dismissal: she has never been a named plaintiff in the case. While the Court appreciates the effort to keep the record clear, it also notes that the docket entry wrongly reflects that the notice was filed on behalf of another plaintiff. For that reason (and because it is moot), the Court DIRECTS the Clerk of Court to STRIKE (Doc. 16) the Notice of Voluntary Dismissal from the docket.Signed by Judge Michael J. Reagan on 6/7/2013. (jls)THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED. |
