Wilkerson, IT IS HEREBY ORDERED that DEFENDANTS JOHNSON, ANDERSON, and GODINEZ, and COUNTS 5 and 8 are DISMISSED with prejudice from this action for failure to state a claim upon which relief can be granted. IT IS ALSO ORDERED that as to the negligence, or medical malpractice, claim in COUNT 9 against Defendant BROWN, Plaintiff shall file the required affidavit pursuant to 735 ILL. COMP. STAT. § 5/2-622, within 60 days of the date of t his order. The Clerk of Court shall prepare for DEFENDANTS HAMMOND, BROWN, ILLINOIS DEPARTMENT OF CORRECTIONS, and WEXFORD HEALTH SOURCES, INC.: (1) Form 5 (Notice of a Lawsuit and Request to Waive Service of a Summons), and (2) Form 6 (Waiver of Service of Summons).
