Filing 22 ORDER REGARDING JURISDICTION: This matter is before the Court sua sponte on the issue of federal subject matter jurisdiction. See Foster v. Hill, 497 F.3d 695, 696-97 (7th Cir. 2007) (It is the responsibility of a court to make an independent evaluation of whether subject matter jurisdiction exists in every case.). Plaintiff claims that this Court has subject matter jurisdiction pursuant to 28 U.S.C. 1332. Plaintiff, however, has failed to properly allege the citizenship of the limited liability company defendants: Inference, LLC; Enterprise Rent-A-Car Company of Tennessee, LLC; and Ean Holdings, LLC. Seventh Circuit law clearly holds that, for diversity jurisdiction purposes, the citizenship of an LLC is the citizenship of each of its members. Hukic v. Aurora Loan Services, 588 F.3d 420, 427 (7th Cir. 2009); Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007). Accordingly, pursuant to 28 U.S.C. 1653, Plaintiff is ORDERED to file an Amended Complaint on or before October 17, 2013 to establish the citizenship of the LLC defendants. If Plaintiff fails to file an Amended Complaint in the manner and time prescribed or if, after reviewing it, the Court finds that Plaintiff cannot establish federal subject matter jurisdiction, the Court will dismiss the action for lack of jurisdiction.(Action due by 10/17/2013).
