Filing 92 ORDER: For the reasons stated in the attached memorandum and order, Defendants' motion for summary judgment is GRANTED IN PART and DENIED IN PART. The motion for summary judgment is GRANTED in favor of Defendants Bureau of Prisons, Harvey, and Brooks as to Plaintiff's claim under the Administrative Procedures Act; it is GRANTED in favor of Defendant Brooks as to Plaintiff's deliberate indifference claim; and it is GRANTED in favor of Defendant Winklemeir as to Plaintiff's Fi rst Amendment claim. The motion for summary judgment as to the Religious Freedom Restoration Act claims against Defendants Bureau of Prisons and Winklemeir is DENIED; the Court will proceed to trial on those claims against the Bureau of Prisons and Winklemeir in their official capacities and against Winklemeir for damages in his individual capacity.
