ORDER DISMISSING CASE: IT IS HEREBY ORDERED that Plaintiff has failed to state a claim upon which relief can be granted against any of the defendants; consequently, this action is DISMISSED. All federal claims are DISMISSED with prejudice; supple mental jurisdiction over state law negligence claims is DECLINED and those claims are DISMISSED without prejudice.
