Filing 429 ORDER: On January 28, 2016, the Court entered Judgment in this case. The Judgment was with prejudice as to those parties that had advised the Court that Plaintiff's claims had been settled or otherwise resolved, and without prejudice as to the remainder of the parties who were previously dismissed (see Doc. #427 ). On March 28, 2016, Defendant Ford filed a motion requesting that the Court alter the Judgment to reflect that it had been dismissed with prejudice (Doc. #428 ). Upon reviewing the record, the Court finds that Ford was never dismissed with prejudice, either pursuant to a stipulation of dismissal, motion to dismiss, or any other dispositive motion. Several questions are raised by this filing. The filing does not state the Federal Rule of Civil Procedure under which voluntary dismissal is sought. The pleading is filed in the form of a stipulation or notice rather than a motion. But all 3 of the Defendants mentioned in the voluntary dismissal notice have appeared, moved in response to the complaint (see motion for more definite statement at Doc. 12) and filed crossclaims/answers herein (see Docs. 14, 15, 16). Federal Rule of Civil Procedure 41(a)(i) does not apply, because the opposing parties have filed answers. Filing 49 ORDER SETTING BRIEFING SCHEDULE on #28 , #32 , #38 , #42 and #46 : Plaintiffs, Williams and Linda Hasenberg, commenced this action against 35 Defendants in Madison County (Illinois) Circuit Court. The action was removed to this U.S. District Court by Defendant Crane Co. on December 20, 2013. The complaint alleges, inter alia, that William Hasenberg developed lung cancer from exposure to asbestos contained in products manufactured, distributed, or sold by the named Defendants. Three Defendants (Georgia Pacific, LLC, Ingersoll-Rand Co., and Trane US, Inc.) moved to dismiss the complaint or for more definite statement, a motion on which the Court set a briefing schedule. On January 9, 2014, five additional Defendants (Continental Teves, Inc., Flowserve Corp., Cummins, Inc, Gardner Denver, Inc., and Foster Wheeler Energy Corp.) answered and moved to strike and/or dismiss portions of Plaintiffs' complaint. As to those dismissal motions (Docs. 28, 32, 38, 42, 46), Plaintiff shall respond by February 21, 2014, and Defendants may file a reply brief (no longer than five pages) by March 10, 2014. The complaint alleges that William Hasenberg was exposed to asbestos while working with/around products manufactured, distributed, or sold by the named Defendants, and that he developed lung cancer resulting therefrom. The complaint contains claims based on negligence, willful and wanton misconduct, conspiracy, spoliation of evidence, and loss of consortium. Served on November 20, 2013, Defendant Crane Co. removed the case to this U.S. District Court on December 20, 2013 (see Doc. 3, 8-page removal notice with roughly 1600 pages of exhibits/attachments). Crane invokes the subject matter jurisdiction of this Court via the federal officer removal statute, 28 U.S.C. 1442(a)(1), which permits removal to federal court by the United States, an agency of the United States, or any officer (or person acting under an officer) of the United States or its agencies, for acts under color of office. Crane asserts that it was acting under the specific direction and control of the U.S. Navy in designing and manufacturing the asbestos-containing products which Plaintiffs claim caused their injuries herein. On January 2, 2014, three other Defendants (Georgia-Pacific, LLC, Ingersoll-Rand Company, and Trane U.S., Inc.) filed answers, cross-claims, and a motion for more definite statement or dismissal. The Court sets the following briefing schedule. On or before February 10, 2014, Plaintiffs shall respond to the motion for more definite statement/dismissal (Doc. 12). That response shall include a section addressing this Court's subject matter jurisdiction (i.e., whether jurisdiction lies under the theory set forth in the removal notice). Defendants (the 3 movants as well as Crane) may file a reply brief no longer than 5 pages by March 3, 2014. (As to #12 - Response due by 2/10/2014, Replies due by 3/3/2014.)
