The Amended Complaint is therefore DISMISSED with prejudice. Plaintiff is advised that this dismissal shall count as one of his allotted strikes under the provisions of 28 U.S.C. § 1915(g). TAYLOR and ASSISTANT WARDEN TREADWAY, are all DISMISSED without prejudice, as no colorable legal claims have been stated. Accordin gly, Plaintiff's motion for a preliminary injunction (Doc. 2) is DENIED without prejudice. IT IS FURTHER ORDERED that, on or before November 27, 2015, Plaintiff shall file an amended complaint. Failure to file an amended complaint will result in the dismissal of this action with prejudice and a strike will be assessed against Plaintiff for purposes of 28 U.S.C. § 1915(g).
