May 25, 2016 Opinion or Order Filing 26 ORDER granting in part and denying in part 12 Motion to Dismiss for Failure to State a Claim and denying 12 Motion to Dismiss Case for Lack of Jurisdiction: For the reasons thoroughly explained in the attached Order, the Court GRANTS IN PAR T and DENIES IN PART Defendants' motion to dismiss (Doc. 12). Any Title VII claims, any Section 1983 claim against the DCEO, and any Section 1983 claims against Biggam and Pollet in their official capacities are dismissed with prejud ice. The remainder of the complaint (including any Section 1983 claim against Biggam or Pollet in his individual capacity) is dismissed without prejudice. To the extent Plaintiff may have some other cognizable claim against the DCEO, Biggam, and Pollet, or a Section 1983 individual capacity claim against Biggam or Pollet, she will be given an opportunity to amend the complaint to state a cognizable claim against them.
