ORDER granting in part and denying in part 54 Motion for Summary Judgment; granting 59 Motion for Summary Judgment. As indicated in the attached Order, all of Plaintiff's claims against Defendants Lang and Wexford are DISMISSED with pr ejudice. Defendants Lang and Wexford shall be terminated from the case. Plaintiff's claims against Dr. Trost relating to his treatment of Plaintiff prior to July 18, 2014 are also DISMISSED with prejudice. The claims against Dr. Tr ost for his treatment from July 18, 2014 onward shall go forward, however. As this matter is now proceeding to trial, the Court will appoint counsel to represent Plaintiff via separate Order, and will then set this matter for a Status Conference to schedule a trial date. ORDER: For the reasons set forth in the attached Memorandum and Order, Defendants' motion for summary judgment (Doc. 34 ) is GRANTED in part and DENIED in part. The motion is granted in that Plaintiff concedes that he has not exhausted hi s administrative remedies as to Defendants Moldenhauer, Shearing and Garcia; the Court DISMISSES those three Defendants without prejudice. The motion is denied in that the Court finds Plaintiff did exhaust his administrative remedies as to Wexford. Wexford remains as a Defendant in this suit.
