IT IS HEREBY ORDERED that the Complaint (Doc. 1) is DISMISSED without prejudice with respect to COUNT 1 and with prejudice with respect to COUNT 2, each for failure to state a claim upon which relief may be granted.As to Count 1, Plaintiff is GRANTED leave to file a First Amended Complaint on or before March 27, 2017.
