IT IS FURTHER ORDERED that the First Amended Complaint is DISMISSED without prejudice as to Count 3 and with prejudice as to Counts 1 and 2, for failure to state a claim upon which relief may be granted. IT IS FURTHER ORDERED that, should he wish to proceed with this case, Plaintiff shall file a Second Amended Complaint, stating any facts which may exist to support a failure to protect claim, within 28 days of the entry of this order (on or before August 31, 2017). (Amended Pleadings due by 8/31/2017.) Plaintiff has filed a Motion for Attorney Representation (Doc. 4) and two Motions for Recruitment of Counsel (Docs. 11, 13).
