ORDER: The 329 motion to intervene and the 341 motion to have Defendants pay the settlement are DENIED. IDOC Defendants are DIRECTED to send a new clean copy of the settlement agreement to Buck by December 5, 2022. Buck must complete and return the settlement paperwork without modification to IDOC Defendants no later than December 19, 2022. IDOC Defendants shall file a status report with the Court on or before January 16, 2023, advising the Court of whether the settlement agreement has been fully executed and submitted to Central Management Services for creation of a payment voucher. Buck is WARNED that the refusal to sign and return the documents is grounds for sanctions. The Court may vacate the settlement agreement and dismiss this case with prejudice for failure to comply with an order of the court pursuant to Rule 41(b) of the Federal Rules of Civil Procedure. ORDER: For the reasons stated on the record and in this Order, the oral motion for judgment as a matter of law is GRANTED as to Defendants Tripp, Meyers, Weatherford, and Pappas. The Court does not present any counts to the jury for deliberati on. Counts 1 and 4 are DISMISSED with prejudice. The Clerk of Court is DIRECTED to enter judgment for Defendants Tripp, Meyers, Weatherford, and Pappas at the close of this case. As the settlement agreement between Buck and the IDOC Def endants is still being finalized, the Court will not enter a final judgment order until the parties have notified the Court that the settlement has fully been implemented, including the rendering of payment to Buck. If Buck wishes to file an appeal, he will have 30 days from the entry of judgment to file a notice of appeal. See FED. R. APP. P. 4(a)(1)(A); 28 U.S.C. § 1291. Signed by Judge Stephen P. ORDER: The Court GRANTS in part, DENIES in part, and RESERVES RULING on the motions in limine in accordance with this Order (Doc. 257 , 260 , 263 ).
