Filing 152 ORDER: Defendant Jorden Sparling's motion for summary judgment on the issue of exhaustion (Doc. 129 ) is DENIED. Defendants Sparling, Boyd Miles, and Brandon Smith's motion for summary judgment on the merits of Plaintiff's claims (Doc . 134 ) is GRANTED in part and DENIED in part. It is granted as to Defendant Sparling on Plaintiff's claims of excessive force, assault, and battery, and judgment will be entered in Sparling's favor at the close of the case. It is denied i n all other respects. This matter will proceed to trial as outlined in the attached PDF order.
