July 7, 2017 Opinion or Order Filing 9 MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that the Complaint is DISMISSED without prejudice for failure to state a claim. (Doc.1). Plaintiffs motion for reconsideration is also DENIED. (Doc. 5). IT IS FURTHER ORDERED that, should he wish to proceed with this case, Plaintiff shall file his first amended complaint, stating any facts which may exist to support the personal involvement of any defendant in his conditions of confinement claims and any related claims, within 30 days of the entry of th is Order. Failure to file an amended complaint shall result in the dismissal of this action with prejudice. Such dismissal shall count as one of Plaintiffs three allotted strikes within the meaning of 28 U.S.C. § 1915(g). No service shall be ord ered on any Defendant until after the Court completes its § 1915A review of the First Amended Complaint. IT IS HEREBY ORDERED that Counts 2-11, which are unrelated to Count 1, are severed into 3 separate cases. The firs t case shall contain Counts 2-7 and shall be against Tripp, John Doe 2 and John Doe 3. The second case shall contain Counts 8-10 against John Doe 4 and Rodely. The third case shall contain Count 11. Defendants Tripp, Rodely, and John Does 2-4 shall b e DISMISSED from this case without prejudice. IT IS FURTHER ORDERED that the only claims remaining in this action is Count 1. John Doe (2 - 3rd Shift Sgt.), John Doe (3 - Nurse or Medical Provider), Jacqueline Lashbrook (Warden), Counselor Rodely, Nurse Tripp, John Doe (4 - C/O working in Law Library) and John Doe (1 - Segregation Major) terminated.
