ORDER granting 32 Motion to Dismiss for Failure to State a Claim and granting 40 Motion to Dismiss. The Court DISMISSES with prejudice the RICO claim, Count I of the amended complaint. Further, the Court DECLINES supplemental jurisdiction ove r the state law claims and dismisses without prejudice those claims: Counts II, III and IV of the amended complaint.
