Filing 5 IT IS HEREBY ORDERED that the Complaint is DISMISSED with prejudice with respect to COUNTS 1 and 2 and without prejudice with respect to COUNT 3, all for failure to state a claim upon which relief may be granted. COUNT 4 is DISMISSED without prejud ice to Plaintiff bringing the claim in state court. Plaintiff is GRANTED leave to file a First Amended Complaint on or before 2018. Should Plaintiff fail to file his First Amended Complaint within the allotted time or consistent with the instructi ons set forth in this Order, the entire case shall be dismissed with prejudice for failure to comply with a court order and/or for failure to prosecute his claims.
