Filing 6 Order re: Doc. 5. On October 1, 2018, the Court directed Petitioner to inform the Court whether he intended to proceed with this action. Petitioner responded to the Court's order on October 15, 2018, affirmatively stating that he mistakenly filed this identical habeas action because he was told that his habeas petition was lost. As it appears that this matter was opened in error, the Clerk of Court is DIRECTED to close this case as mistakenly opened and duplicative of 18-cv-1528. No filing fee shall be assessed for this action. Petitioner is informed that the Court has not received a filing fee for this action and none is due. Per his request, Petitioner is further informed that the Court has not received a check from him since September 25, 2018, when it returned Petitioner's check to him for having an incorrect payee listed. Filing 4 Order re Doc. 1. Petitioner brought this action on September 13, 2018. A review of the Court's docket shows that Petitioner has an identical case pending since August 23, 2018, No. 18-1528, which was opened after Petitioner sent a motion for status to the Court asking about a habeas petition that the Court had not received as of that date. This Petition is signed on July 4, 2018, suggesting that it may be the missing petition. In the interest of clarity, Petitioner is directed to inform this Court in writing whether he intends to proceed on this duplicate habeas action. Failure to respond to this order will result in dismissal of this action. Petitioner shall have until October 22, 2018 to file a written response.
