October 23, 2019 Opinion or Order Filing 17 This Court has received your complaint and initial partial filing fee from the Central District of Illinois, previously assigned case number: 19-1237-CSB. Your new case number is 19-1148-SMY. The following is some information you should know regarding the initial stages of your lawsuit. October 22, 2019 Opinion or Order Filing 15 MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 10/22/2019. Plaintiff has improperly joined his claims against Menard Tactical Team Leader Aaron Campbell with his claims against Pontiac Correctional Center Warden Teri Kennedy. Pursuant to Federal Rule of Civil Procedure 21, the claims involving Defendant Campbell and Menard Correctional are severed and transferred to the Southern District of Illinois for proper venue. See Fed. R. Civ. P. 20; 28 U.S.C. Sec 1391(b). Plaintiff's remaining claims against Pontiac Correctional Center are dismissed for failure to state a claim upon which relief can be granted and as a violation of Rule 8 of the Federal Rules of Civil Procedure. Plaintiff must file a proposed amended complaint concerning his claims against Pontiac Correctional Center within 21 days of this order or on or before November 12, 2019. If Plaintiff fails to file his amended complaint on or before November 12, 2019 or fails to follow the Court's directions, his case may be dismissed with prejudice. Plaintiff's motion for appointment of counsel is denied with leave to renew after Plaintiff clarifies his claims. #5 . Plaintiff's motion for a Hydro- specialist and motion for a status update are both denied. #13 , #14 . August 30, 2019 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 8/30/2019. Plaintiff has filed a letter with the Court alleging the Warden is instructing unnamed Pontiac Correctional Center staff members to retaliate against Plaintiff. #8 . Plaintiff complains about frivolous disciplinary tickets, problems making copies of unspecified documents to provide to Defendants, and fear of future bad acts. There are several problems with Plaintiff's filing. First, the Plaintiff must not file letters with the Court. Instead, if Plaintiff is requesting action, he must file a "motion" indicating what action he is requesting. This prevents confusion over the purpose of any filing. Second, the Court has not yet had an opportunity to review the claims in Plaintiff's complaint and enter an order pursuant to 28 U.S.C. Sec 1915A. Once the Court enters a merit review order, then the Court will attempt to serve the Defendants. However, the Defendants are not currently in this case and therefore Plaintiff should not send documents to any Defendant. Third, Plaintiff has not articulated a current threat to his safety, and he must first address any concerns about retaliation through the grievance procedure at his institution. July 17, 2019 Opinion or Order TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $20.26. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff's account to the Clerk of Court.
