ORDER: Plaintiff's Complaint (Doc. #1 ) survives initial screening in part. Plaintiff's request for preliminary injunctive relief is DENIED without prejudice. Defendants Shah, Moldenhauer, Zimmer, Crain and Wexford are DISMISSED without prejudice and the Clerk of the Court is DIRECTED to TERMINATE them from the case in the CM/ECF system. The Clerk of the Court is DIRECTED to ADD the acting Warden of Menard, Alex Jones (in his official capacity) as a defendant in this action for purposes of carrying out any injunctive relief that may be ordered. The Clerk of Court shall prepare for Ritz, Trost, Siddiqui and Jones: (1) Form 5 (Notice of a Lawsuit and Request to Waive Service of a Summons), and (2) Form 6 (Waiver of Service of Summons). ORDER DENYING Plaintiff's motion to proceed in forma pauperis (Doc. #2 ). A federal court may permit an indigent party to proceed without pre-payment of fees. 28 U.S.C. Section 1915(a)(1). The Court is not satisfied from Selvie's affidavit that he is indigent. Plaintiff's trust fund account balance as of March 30, 2020 was $425.00 (Doc. #2 ). Accordingly, the Court DENIES the motion for leave to proceed in forma pauperis (Doc. #2 ). Plaintiff shall pay the $400.00 filing fee no later than May 4, 2020. Failure to comply with this Order will result in dismissal of this action for failure to comply with a court order under Federal Rule of Civil Procedure 41(b). Fed. R. Civ. P. 41(b).
