Each party shall bear its own costs, unless otherwise provided in the settlement documents. Defense Counsel is DIRECTED to forward a proposed Settlement Agreement to Plaintiff's Counsel within 30 days from the date of this Order. Defense Counsel is further DIRECTED to file a status report within 60 days from the date of this Order, advising the Court whether the Settlement Agreement has been fully executed and submitted to CMS for payment. December 9, 2020 Opinion or Order Filing 40 JURISDICTIONAL ORDER: This matter is before the Court sua sponte on the issue of federal subject matter jurisdiction. See Foster v. Hill, 497 F.3d 695, 696-97 (7th Cir. 2007) ("It is the responsibility of a court to make an independent evaluation of whether subject matter jurisdiction exists in every case."). Upon further review of the Amended Complaint (Doc. 11), the Court noticed the allegations regarding the citizenship of Plaintiffs are deficient. Plaintiffs Daniel Truelove and Christina Hendrix brought claims on behalf of themselves, as well as, on behalf of the estate of their daughter Audria Truelove. They alleged Audria's citizenship, which covers the claims they brought on behalf of her estate. 28 U.S.C. 1332(c)(2). They did not allege their own citizenship, however, which is necessary for the wrongful death claims that they brought on behalf of themselves. Accordingly, Plaintiffs are ORDERED to file a Second Amended Complaint by January 5, 2021 that clearly sets forth all of the information needed to determine whether the parties are completely diverse. If Plaintiffs fail to file an Amended Complaint in the manner and time prescribed or if, after reviewing it, the Court finds that Plaintiffs cannot establish complete diversity, the Court may be required to dismiss this action for lack of federal subject matter jurisdiction. Plaintiffs filed this action on August 17, 2020 based on the complete diversity of the parties (Doc. 1). However, the allegations regarding the citizenship of Defendant United Van Lines, LLC and Unigroup, C.A. are deficient. The citizenship of an LLC for diversity purposes is the citizenship of each of its members. See, e.g., Copeland v. Penske Logistics, LLC, 675 F.3d 1040, 1043 (7th Cir. 2012). The citizenship of an unincorporated entity is likewise the citizenship of each of its members. Americold Realty Tr. v. Conagra Foods, Inc., 136 S. Ct. 1012, 1015 (2016). Consequently, the jurisdictional statement for these two Defendants must identify the citizenship of each of its members as of the date the complaint was filed, and, if those members have members, the citizenship of those members as well, until a corporation or a natural person is reached. West v. Louisville Gas & Elec. Co., 951 F.3d 827, 829 (7th Cir. 2020); Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007). Accordingly, Plaintiffs are ORDERED to file an Amended Complaint by September 17, 2020 that clearly sets forth all of the information needed to determine whether the parties are completely diverse. Beatty pursuant to Administrative Order No. 257. The parties are advised that their consent is required if the assigned Magistrate Judge is to conduct all further proceedings in the case, including trial and final entry of judgment pursuant to 28 U.S.C. 636(c) and Federal Rule of Civil Procedure 73.
