The time for doing so has long passed, and in spite of a warning and additional time to do so, said party continues to ignore the Court's directive by not returning the form. September 9, 2020 Opinion or Order Filing 4 ORDER re #1 Complaint filed by Thomas Byrd. The Court received Plaintiff's Complaint form, including the parties, litigation history, and grievance process but not statement of claim on September 3, 2020. Because the form did not include a case number, the Clerk of Court opened the instant action. This case appears, however, to be duplicative of another case that is pending in this District. See Byrd v. Thompson, Case No. 20-cv-809-NJR ("original case"). Plaintiff recently filed a statement of claim and request for relief in the original case but did not include the entire Complaint form. It is possible that Plaintiff did not intend to open this new action but for the portions of the form to be added to his original case. Therefore, Plaintiff is hereby ORDERED to advise the Court, in writing in this case (No. 20-cv-897-NJR), on or before October 9, 2020, whether he intends to pursue this action. If Plaintiff timely advises the Court that he did not mean to open a new case, the Court will close this case without assessing a filing fee for this matter. Failure to timely respond to this Order may result in the dismissal of this action with the assessment of a filing fee. See Fed. R. Civ. 41(b).. Signed by Chief Judge Nancy J. September 3, 2020 Opinion or Order Filing 3 NOTICE AND ORDER: The Court has received your Complaint. Your case number is 20-897-NJR. Within 30 days of the entry of this Order, you are ORDERED to submit the $400.00 filing fee or a motion to proceed without prepayment of the filing fee. If you file a motion to proceed without prepayment of the filing fee, the Court must review your trust fund account statement for the six-month period immediately preceding the filing of this action. Thus, you must have the Trust Fund Officer at your facility complete the attached certification and provide a copy of your trust fund account statement (or institutional equivalent).
