May 14, 2020 Filing 23 MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff has responded to defendants' motion to dismiss or transfer venue, but they have also moved to compel the defendant to file an answer to the complaint. Plaintiff contends that a party has only two choices in responding to the complaint: move to dismiss it under Rule 12(b)(6), or file an answer. Because defendants' motion is a motion to dismiss for improper venue under Rule 12(b)(3), plaintiff argues, they have to file an answer. The Court disagrees; this is not what Rule 12 says. Rule 12(a)(1) says that a defendant must answer a complaint within a specified period ("file a responsive pleading," in Federal Rules lingo, see also Fed. R. Civ. P. 7(a), defining "pleadings"), but Rule 12(a)(4) says that if a motion "under this Rule" (i.e. Rule 12) is filed, the defendant does not have to answer until the motion is ruled upon (with other alternatives not applicable here). Defendants did file a motion "under this Rule"; they filed a Rule 12(b)(3) motion seeking dismissal. So they do not have to answer until the Court denies that motion or postpones it to trial.
