December 23, 2020 Opinion or Order Filing 22 ORDER DENYING #20 Motion for Temporary Restraining Order (TRO) and #21 Motion for Lien. Plaintiff seeks a TRO against Nurse Reynolds and a lien against her bank accounts. He also seeks blood pressure, pain, and possibly other medications prescribed by an outside physician. As the Court previously explained (see Doc. 19), Plaintiff must establish the following to obtain interim injunctive relief: (1) that there is a reasonable likelihood that he would succeed on the merits of his claim(s); (2) that there is no adequate remedy at law; (3) that absent an injunction, he will suffer irreparable harm; (4) that the irreparable harm suffered by plaintiff in the absence of the injunctive relief will outweigh the irreparable harm that defendants will endure were the injunction granted; and (5) that the public interest would be served by an injunction. Teamsters Local Unions Nos. 75 and 200 v. Barry Trucking, 176 F.3d 1004, 1011 (7th Cir. 1999). Plaintiff offers no reason for seeking a TRO (or lien) against Nurse Reynolds. Although the Court presumes he seeks certain blood pressure and pain medication that the nurse has not yet given him, Plaintiff does not actually state this. He offers absolutely no reason for his requests. The Court will not grant either drastic form of relief absent any stated reason. Both motions are denied. Before filing another motion, Plaintiff should first make every effort to obtain the medications without the court's intervention. He should ask jail and medical staff to outline the steps he must take to secure this medication; then, he should take each of those steps to obtain his medication. Signed by Judge J. December 18, 2020 Opinion or Order Filing 19 ORDER DENYING #18 Motion for Prescriptions. Plaintiff seeks a court order requiring the defendants to provide him with seven different prescription medications. He states that Walmart and two outside medical providers have the orders for these prescriptions. To obtain interim relief in the form of a temporary restraining order or preliminary injunction under Fed. R. Civ. P. 65(a) or (b), Plaintiff must establish: (1) that there is a reasonable or substantial likelihood that he would succeed on the merits of his claim(s); (2) that there is no adequate remedy at law; (3) that absent an injunction, he will suffer irreparable harm; (4) that the irreparable harm suffered by plaintiff in the absence of the injunctive relief will outweigh the irreparable harm that defendants will endure were the injunction granted; and (5) that the public interest would be served by an injunction. Teamsters Local Unions Nos. 75 and 200 v. Barry Trucking, 176 F.3d 1004, 1011 (7th Cir. 1999). Plaintiff has not addressed any of these factors in his motion. He has also failed to provide enough information to warrant the issuance of a sweeping order requiring the defendants to give him the medication he seeks. Plaintiff's Complaint and First Amended Complaint do not even refer to all seven medications, and Plaintiff does not explain when/why he received each prescription in the first place. He fails to support the motion with documented evidence that he requires each prescription medication at this time. Moreover, Plaintiff has not described what, if any, steps he/his family has taken to secure copies of the orders for his prescriptions, to request these prescriptions from family and jail staff, or describe each defendant's response to said requests. November 16, 2020 Opinion or Order Filing 9 ORDER GRANTING Plaintiff's motion to proceed in forma pauperis ("IFP") (Doc. #3 ). Plaintiff has been without funds for six months, he is currently without funds, and he appears to have no means currently with which to pay an initial partial filing fee. Accordingly, the Court will not assess an initial partial filing fee. See 28 U.S.C. Section 1915(b)(4). Plaintiff shall make monthly payments of 20% of the preceding month's income credited to Plaintiff's prison trust fund account (including all deposits to the inmate account from any source) until the $350.00 filing fee is paid in full. The agency having custody of Plaintiff shall forward payments from Plaintiff's account to the Clerk of this Court each time the amount in the account exceeds $10 until the $350.00 filing fee is paid.In addition, Plaintiff shall note that the filing fees for multiple cases cumulate. See Newlin v. Helman, 123 F.3d 429, 436 (7th Cir. 1997), overruled in part on other grounds by Lee v. Clinton, 209 F.3d 1025 (7th Cir. 2000); Walker v. O'Brien, 216 F.3d 626 (7th Cir. 2000). A prisoner who files one suit must remit 20% of his monthly income to the Clerk of the Court until his fees have been paid; a prisoner who files a second suit or an appeal must remit 40%; and so on. Newlin, 123 F.3d at 436. "Five suits or appeals mean that the prisoner's entire monthly income must be turned over to the court until the fees have been paid." Id. Payments shall be mailed to: Clerk of the Court, United States District Court for the Southern District of Illinois, 750 Missouri Avenue, East St. Louis, Illinois 62201. October 28, 2020 Opinion or Order Filing 7 ORDER DISMISSING #1 Complaint and DENYING #2 Motion for Recruitment of Counsel. The Complaint (including COUNT 1) is DISMISSED without prejudice for failure to state a claim for relief against both defendants. Plaintiff is GRANTED leave to file a "First Amended Complaint" on or before November 25, 2020. Should Plaintiff fail to do so within the allotted time or consistent with the instructions set forth in this Order, the entire case shall be dismissed with prejudice. FED. R. CIV. P. 41(b). October 28, 2020 Opinion or Order Filing 6 ORDER: Plaintiff has filed a Motion for Leave to Proceed in Forma Pauperis ("IFP") in this case (see Doc. #3 ), but has failed to provide the necessary prisoner trust fund account information as required by the PLRA to determine whether the inmate is entitled to proceed without prepaying fees and costs. Pursuant to 28 U.S.C. Section 1915(b)(1), the Court must review the prisoner trust fund account statement for the 6 month period immediately preceding the filing of this action. IT IS THEREFORE ORDERED that Plaintiff shall provide the Clerk of Court with the attached certification completed by the Trust Fund Officer at the facility and a copy of his/her trust fund account statement (or institutional equivalent) for the period 4/1/2020 to 10/26/2020 no later than 45 days from the date of this order. Failure to do so will result in dismissal of this action for failure to comply with an Order of this Court. Fed. R. Civ. P. 41(b). See generally Ladien v. Astrachan, 128 F.3d 1051 (7th Cir. 1997); Johnson v. Kamminga, 34 F.3d 466 (7th Cir. 1994).
