Filing 31 ORDER DENYING Plaintiff Nathaniel Fleming's motion to proceed in forma pauperis (Doc. #24 ). A federal court may permit an indigent party to proceed without pre-payment of fees. 28 U.S.C. Section 1915(a)(1). The Court is not satisfied from Fleming's affidavit that he is indigent. Plaintiff Fleming's trust fund account balance as of October 21, 2020 was $526.73 (Doc. #24 ). Accordingly, the Court DENIES the motion for leave to proceed in forma pauperis (Doc. #24 ). Plaintiff shall pay the $400.00 filing fee no later than December 18, 2020. Failure to comply with this Order will result in dismissal of Plaintiff Fleming from this action for failure to comply with a court order under Federal Rule of Civil Procedure 41(b). Fed. R. Civ.
