Filing 8 ORDER. Before the Court is Plaintiff Londiae Hayes' Motion for Leave to Proceed in forma pauperis. (Doc. #4 ). Because the Plaintiff's pleading is unsigned, the Court DIRECTS the Clerk of Court to strike Plaintiff's motion. Plaintiff may re-file the motion with the required signature. Signed by Judge David W. Dugan on 1/6/2021. (dmw2)THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED. |
Filing 7 ORDER. Before the Court is a Motion to Appoint Counsel by Londiae Hayes. (Doc. #5 ). When presented with a request to appoint counsel, the Court must make the following inquiries: (1) has the indigent plaintiff made a reasonable attempt to obtain counsel or effectively been precluded from doing so, and (2) given the difficulty of the case, does the plaintiff appear competent to litigate on his or her own. See Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007). The Court notes that it does not appear that Hayes meets the threshold burden of attempting to recruit counsel on her own. Although she indicates that she has called several attorneys to no avail, the Court is not inclined to recruit counsel on her behalf at this time. This case is in the early stages of litigation and the Plaintiff has demonstrated that she can articulate clearly and effectively on her own behalf. Hayes may re-file her motion at a later date, if appropriate, but the motion for appointment of counsel (Doc. #5 ) is DENIED at this time. Signed by Judge David W. Dugan on 1/6/2021. (dmw2)THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED. |
