March 10, 2021 Opinion or Order Filing 35 ORDER re #33 Motion for Extension of Time: Plaintiff asks for additional time to return his form indicating whether he consented to proceeding before a Magistrate Judge (see Doc. 25). He has already returned that form, however, and therefore his request is MOOT. Plaintiff also asks to receive electronic notices and communications from the Court. Plaintiff is hereby GRANTED access (via login and password) to the District Court's electronic case filing system. In order to access the system, Plaintiff must go to the District Court's website and complete the Electronic Filing Registration Form (www.ilsd.uscourts.gov, click on "Electronic Case Filing" tab). He can contact the ECF HelpDesk at (866) 867-3169 if he has questions concerning registration. Plaintiff should also review the Electronic Filing Rules prior to utilizing the system. The Clerk's Office shall provide a copy of this Order to Plaintiff by regular mail. January 19, 2021 Opinion or Order Filing 14 ORDER. Plaintiff filed this lawsuit in the United States District Court for the Northern District of Illinois on October 21, 2020 (Doc. 1) and it was transferred to this District on January 13, 2021 (Doc. 10). Upon review of the case, the Court notes that Defendants have not been served. Under Federal Rule of Civil Procedure 4(m), "[i]f a defendant is not served within 90 days after the complaint is filed, the court--on motion or on its own after notice to the plaintiff--must dismiss the action without prejudice against that defendant or order that service be made within a specified time." Therefore, Plaintiff had until January 19, 2021 to serve Defendants, but appears to have taken no action to do so. If Plaintiff wants the Clerk's Office to serve process on Defendants, Plaintiff SHALL FILE a Motion for Service of Process at Government Expense within 14 days of the date of entry of this order (on or before February 2, 2021). The Clerk of Court is DIRECTED to mail to Plaintiff the Court's form Motion for Service of Process at Government Expense. If Plaintiff does not timely file a motion for service of process at government expense, it shall be Plaintiff's responsibility to have Defendants served with a summons and copy of the Complaint pursuant to Rule 4. Plaintiff is advised that only a non-party may serve a summons. Fed. R. Civ. P. 4(c)(2). If Plaintiff does not file a motion for service of process at government expense within 14 days as ordered, the Clerk shall then prepare a summons for each Defendant and shall forward the summonses and sufficient copies of the Complaint and this Memorandum and Order to Plaintiff so that he may have Defendants served.
