ORDER: Plaintiff's Motions to Reconsider Assigning an Attorney [192, 195] are DENIED. Plaintiff describes a variety of medical ailments that he alleges make it difficult for him to file an amended complaint such as, 4 TIA strokes, a MRSA infection, covid-19 infections (July 31, 2020, January 16, 2021, December 31, 2021), blurred vision and pain. Although these symptoms may make it difficult to prepare pleadings, the majority of the issues appear to have existed before Plaintiff even initiated this litigation, or other litigation before this Court (see e.g. Belk v. Mayor, et al., 21-cv-1235-NJR, filed October 13, 2021). Despite his apparent ailments, Plaintiff has found ways to initiate or participate in an impressive number of cases in this District in the past few years. See, Belk v. Collins, 19-cv-499; Belk v. Police Dept., 20-cv-159; Belk v. Mayor, 21-cv-1253; Belk v. Watson, 21-cv-139; Belk v. Watson, 21-cv-341. Plaintiff's conduct does not suggest an inability to file documents. Additionally, Plaintiff is reminded that his amended pleading should be short. His earlier pleadings have failed because he includes too many claims against too many parties that are not suitable to proceed jointly in a single case. Additionally, Plaintiff's Motions to Inform [189, 194] are DENIED. "Motions to Inform" cannot be used as piecemeal amendments to add claims or facts to the record. If Plaintiff continues to file extraneous documents they may be stricken. Plaintiff's amended complaint is currently due today. He has already received extensions to move the deadline from January 27, 2022 and March 14, 2022. He will be given one final extension, his amended complaint is due June 1, 2022. Failure to file an amended complaint will result in the dismissal of this lawsuit for failure to prosecute. Further extensions will not be granted. Signed by Judge David W. Dugan on 5/16/2022. ORDER granting in part #183 Motion to Inform and Request for Filing Extension. The Court GRANTS Plaintiff Belk's request for an extension of his deadline to file an amended complaint. The Second Amended Complaint is due on or before March 14, 2022. Failure to file an amended complaint by this date will result in dismissal. The request to add McNeal as a plaintiff and schedule a video conference to discuss torturous mail interference is DENIED. To obtain emergency injunctive relief, a party must demonstrate that (1) his underlying case has some likelihood of success; (2) no adequate remedy at law exists; and (3) he will suffer irreparable harm without the relief. See Merritte v. Kessel, 561 F. Appx 546, 548 (7th Cir. 2014) (citations omitted)). The merits of this case cannot be assessed without an operative Second Amended Complaint. Additionally, the Court cannot exercise jurisdiction over anyone prior to service of the complaint on the defendants. Finally, other than generalized claims, Belk has not identified any specific document he has been prevented from mailing to this Court, and he has no constitutional right to an effective grievance process at the institution where he is being held. Thus, the Court denies the request for emergency relief. However, to ensure the Court has received everything Belk has mailed. The Clerk of Court is DIRECTED to mail Belk a copy of the docket sheet in this case for his review. The Court is aware that Belk is litigating pro se other civil cases in this district. If he is concerned about the Court receiving the correct documents in any of those cases, he must file a motion in the appropriate case. ORDER granting in part #179 Motion to Dismiss Filing Fee. Plaintiff Warlock has filed a motion asking the Court to reimburse him the money that has been paid and "dismiss the rest of the filing fee." He states that he has been overcharged for this lawsuit and was informed by another plaintiff that he would only have to pay a portion of the $350 filing fee in this multi-plaintiff litigation. As Warlock was advised, regardless of the number of plaintiffs, each plaintiff is responsible for paying the full filing when proceeding IFP. See Doc. #5 citing 28 U.S.C. 1915(b). ORDER: Plaintiff Belk has filed three motions requesting (1) to add evidence to the Amended Complaint; (2) copies of documents he has filed; and (3) a court order directing Captain Shan Collins to provide him copies of his complaints and grievances. (Docs. #173 , #174 , and #176 ). All three motions are DENIED. The Court does not accept piecemeal amendments or modifications to a complaint. If Plaintiff Belk wishes to amend the complaint by adding additional allegations or exhibits, he must file a motion for leave to amend and submit a proposed amended complaint. The amended complaint must stand on its own and include all claims against all defendants and all exhibits, without reference to any other document. Plaintiff Belk is advised that the Court does not provide copies of a party's own filings; however, if Plaintiff Belk submits two copies of a filing to the Court, the Court will return a copy. The Clerk of Court will mail paper copies of any document only after receiving prepayment of the required fee, $.50 per page.
