SCREENING ORDER: Plaintiff is a former detainee at Madison County Jail. Represented by counsel, he brings this civil rights action pursuant to 42 U.S.C. 1983 against Madison County Jail officials for denying him adequate medical care for a dislocated prosthetic hip during his detention at the Jail from March 16-18, 2019. Under 28 U.S.C. 1915A, the Court is required to conduct a prompt threshold review of the Complaint. Accepting the allegations as true, the Court finds that Plaintiff has articulated a colorable federal cause of action against ALL DEFENDANTS, except Sheriff Lakin, for denying him adequate medical care for his dislocated hip in violation of his rights under the Fourteenth Amendment Due Process Clause (Count 1) and against Defendant LAKIN for instituting an unofficial policy, custom, or practice of withholding medical care from detainees in violation of Plaintiff's rights under the Fourteenth Amendment Due Process Clause (Monell claim) (Count 2). Accordingly, counsel for Plaintiff may initiate service without further delay on ALL DEFENDANTS. Defendants are ORDERED to timely file an appropriate responsive pleading to the complaint and shall not waive filing a reply pursuant to 42 U.S.C. 1997e(g). Signed by Judge J.
