April 9, 2021 Opinion or Order Filing 4 ORDER TRANSFERRING CASE TO OTHER DISTRICT: Plaintiff has submitted a mandamus petition seeking sentence credit. He is incarcerated at the Graham Correctional Center where he is serving a state sentence. He names as Defendants the Warden and records officer of Graham Correctional Center, the Prisoner Review Board, and the Director of the Illinois Department of Corrections. (Doc. #1 ). Venue for a federal civil action is governed by 28 U.S.C. Sec. 1391(b). According to that statute, such actions may be brought only in (1) the judicial district where any defendant resides (if all defendants reside in the same State), (2) a judicial district in which a substantial part of the events or omissions giving rise to the claim occurred, or (3) a judicial district in which any defendant is subject to the court's personal jurisdiction with respect to the action, if there is no district in which the action may otherwise be brought. None of the Defendants appear to reside within the Southern District of Illinois. A substantial part of the events or omissions giving rise to Plaintiff's allegations occurred at the Graham Correctional Center in Montgomery County, Illinois, which is situated in the federal judicial district for the Central District of Illinois. 28 U.S.C. Sec. 93(b). The Court therefore finds that the Central District is the appropriate forum for the hearing and determination of this mandamus action. Pursuant to 28 U.S.C. Sec. 1404(a), and on the Court's own motion, IT IS THEREFORE ORDERED that this action is TRANSFERRED to the United States District Court for the Central District of Illinois, for such further proceedings as that court may deem appropriate. No summons shall issue in this action unless so directed by the transferee court.Case transferred to Central District of Illinois. Signed by Chief Judge Nancy J. Rosenstengel on 4/9/2021.
