May 6, 2021 Opinion or Order Filing 8 ORDER: Plaintiff filed #6 "Notice of Voluntary Dismissal," seeking to dismiss this action without prejudice. Under Federal Rule of Civil Procedure 41(a)(1)(A)(i), the plaintiff may dismiss an action without a court order at any time before the opposing party serves either an answer or a motion for summary judgment. In this case, Defendants have not filed an answer or motion for summary judgment, and Plaintiff's notice appears proper under 41(a)(1)(A)(i). Therefore, Plaintiff's notice of dismissal is effective immediately upon filing and does not require judicial approval. See Nelson v. Napolitano, 657 F.3d 586 (7th Cir. 2011).
