Under 28 U.S.C. sec. 1332, a federal district court has original subject matter jurisdiction over actions involving complete diversity between the parties and an amount in controversy exceeding $75,000, exclusive of interests and costs. See 28 U.S.C. sec. 1332(a)(1); LM Ins. Corp. v. Spaulding Enters. Inc., 533 F.3d 542, 547 (7th Cir. 2008). As both parties agree that the amount in controversy does not exceed $75,000, the Court REMANDS this case to St. Clair County Circuit Court for lack of federal subject matter jurisdiction.
