October 20, 2021 Opinion or Order Filing 11 ORDER DENYING #10 Motion to Rescind Order to Pay Filing Fee and Grant Voluntary Retraction of Suit re: #8 Order Dismissing Case. Plaintiff asks this Court to vacate the Order Dismissing Case (Doc. 8) and Judgment (Doc. 9), and allow him to voluntarily dismiss the case without any filing fee obligation. When his Motion for Leave to Proceed in forma pauperis was denied and the Court ordered him to pay the full filing fee of $402.00, Plaintiff was under the impression that he could simply ignore the Court's Order and avoid his filing fee obligation. That is not so. Plaintiff should refer to the language in the Order Dismissing Case, itself, which states: "Plaintiff's obligation to pay the filing fee for this action was incurred at the time the action was filed, thus the filing fee of $402.00 remains due and payable." (Doc. 8, pp. 1-2) (citing 28 U.S.C. 1915(b)(1); Lucien v. Jockisch, 133 F.3d 464, 467 (7th Cir. 1998)). The motion is DENIED. Signed by Judge J. Phil Gilbert on 10/19/2021. August 24, 2021 Opinion or Order Filing 6 ORDER DENYING Plaintiff's motion to proceed in forma pauperis (Doc. #2 ). A federal court may permit an indigent party to proceed without pre-payment of fees. 28 U.S.C. 1915(a)(1). The Court is not satisfied from Miller's affidavit that he is indigent. Plaintiff's trust fund account balance as of July 27, 2021 was $465.58 (Doc. #2 ). Accordingly, the Court DENIES the motion for leave to proceed in forma pauperis (Doc. #2 ). Plaintiff shall pay the $402.00 filing fee no later than September 23, 2021. Failure to comply with this Order will result in dismissal of this action for failure to comply with a court order under Federal Rule of Civil Procedure 41(b). Fed. R. Civ. P. 41(b).
