Order: Plaintiff is a pretrial detainee under the Sexually Dangerous Persons Act ("SDPA") in the custody of the Illinois Department of Corrections. Represented by counsel, he brings this civil rights action pursuant to 42 U.S.C. Sec. 1983 and the Americans with Disabilities Act (42 U.S.C. Sec. 12132) and has paid the filing fee in full. Under 28 U.S.C. Sec. 1915A, the Court is required to conduct a prompt threshold review of the Complaint. Accepting Plaintiff's allegations as true, the Court finds that Plaintiff has articulated a colorable federal cause of action against Defendants for constitutional and statutory claims arising from the Defendants' alleged failure to provide him with a constitutionally adequate treatment plan as an SDP and for his mental conditions and disabilities at the Big Muddy River Correctional Center. Counsel for Plaintiff may initiate service without further delay. Defendants are ORDERED to timely file an appropriate responsive pleading to the Complaint and shall not waive filing a reply pursuant to 42 U.S.C. Sec. 1997e(g). Finally, based on the allegations in the Complaint, the Clerk of Court is DIRECTED to ENTER the standard qualified protective order pursuant to the Health Insurance Portability and Accountability Act.
