Date Filed Document Text
January 7, 2022 Opinion or Order Filing 19 ORDER denying (Doc. #17 ) Motion for Recruitment of Counsel. By Motion dated January 7, 2022, Plaintiff Denise M. Campbell asks to have counsel appointed on her behalf. When presented with a request to appoint counsel, the Court must make the following inquiries: (1) has the indigent plaintiff made a reasonable attempt to obtain counsel or effectively been precluded from doing so, and (2) given the difficulty of the case, does the plaintiff appear competent to litigate it herself. See Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007). Presently, Plaintiff appears to have made sufficient attempts to retain counsel on her behalf, satisfying the first prong. However, the Court is not inclined to appoint counsel at this time. Plaintiff's filings in this matter show she can articulate clearly and effectively on her own behalf. Further, this case involves a straightforward claim with no apparent complexity. Plaintiff's Motion (Doc. 17) is therefore DENIED, without prejudice. Plaintiff may renew her request by filing another motion if circumstances change and it becomes necessary to do so as the case progresses, and if the case survives dismissal following the disposition of Defendant's pending Motion to Dismiss at Doc. 10. Signed by Judge David W. Dugan on 1/7/2022. (arm)THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED.
