February 24, 2023 Opinion or Order Filing 78 ORDER: Plaintiff's Motion for Return of the Filing Fee #76 is DENIED. The obligation to pay the filing fee was incurred at the time that Plaintiff filed case number 21-cv-577, along with his application to proceed in forma pauperis, and then when he paid his initial partial fee. Once a fee attaches, it must be paid in full regardless of the outcome of the case. The later joinder of cases 21-cv-1536 and 22-cv-577 did nothing to the filing fees for either case. Accordingly, Plaintiff's Motion for a Refund will be denied. Plaintiff also moved for a free copy of the docket sheet. Plaintiff will be granted #77 a one-time courtesy copy, but he will be required to pay.50 cents per page for future copy requests. November 8, 2022 Opinion or Order Filing 63 ORDER: Plaintiff's Motion for Clarification #61 is GRANTED. In the motion, Plaintiff states that he would like to forgo the opportunity to file a consolidated amended complaint, and that he would like to proceed on the claims as previously defined by the Court. Those claims are: (1) Eighth Amendment deliberate indifference claim against Defendant Shaw for medical treatment provided in April and May of 2021; (2) Eighth Amendment deliberate indifference claim against Defendant Lana Nalewajka for her response to Plaintiff's medical needs [Docs. 13, 42]; (1A) Eighth Amendment claim against Defendants Myers and Brashera-Finney for exhibiting deliberate indifference to Plaintiff's serious medical needs by denying adequate medical treatment for side effects of Mobic on July 27, 2021 [Doc. 60]. Because Plaintiff will not be filing a consolidated amended complaint, the Court asks that he re-submit his amended complaint from case 22-cv-577, so that it may be properly docketed in this consolidated case---21-cv-1536. The Court discovered in the consolidation of these two matters that a few pages of the electronic file from Plaintiff's amended complaint in case 22-cv-577 were damaged. [Case No. 22-cv-577, Docket entry 65]. The pages are pages 13 and 14, it appears based on the rest of the complaint that these two pages were exhibits or grievances. The Court does not believe that the damaged pages impact the substance of the claims presented, because the claims did not change from the original to the amended complaint against Defendants Myers and Brashera-Finney. If Plaintiff does not have copies, the Court will docket the damaged version with a notation about the missing pages. Plaintiff shall submit the missing pages, or notify the Court if he does not have them, by November 21, 2022. At that time, the Court will issue a scheduling order for the case to proceed on Claims 1, 2, and 1A, as defined above. Defendant Nalewajka's Motion for an Extension #62 is granted, a new schedule will issue after November 21, 2022, to give all parties adjusted deadlines now that this matter has been consolidated with 22-cv-577.. December 14, 2021 Opinion or Order Filing 10 ORDER GRANTING Plaintiff's motion to proceed in forma pauperis ("IFP") (Doc. #2 ). Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $70.37. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court upon receipt of this Order. Plaintiff shall make monthly payments of 20% of the preceding month's income credited to Plaintiff's prison trust fund account (including all deposits to the inmate account from any source) until the $350.00 filing fee is paid in full. The agency having custody of Plaintiff shall forward payments from Plaintiff's account to the Clerk of this Court each time the amount in the account exceeds $10 until the $350.00 filing fee is paid.In addition, Plaintiff shall note that the filing fees for multiple cases cumulate. See Newlin v. Helman, 123 F.3d 429, 436 (7th Cir. 1997), overruled in part on other grounds by Lee v. Clinton, 209 F.3d 1025 (7th Cir. 2000); Walker v. O'Brien, 216 F.3d 626 (7th Cir. 2000). A prisoner who files one suit must remit 20% of his monthly income to the Clerk of the Court until his fees have been paid; a prisoner who files a second suit or an appeal must remit 40%; and so on. Newlin, 123 F.3d at 436. "Five suits or appeals mean that the prisoner's entire monthly income must be turned over to the court until the fees have been paid." Id. Payments shall be mailed to: Clerk of the Court, United States District Court for the Southern District of Illinois, 750 Missouri Avenue, East St. Louis, Illinois 62201. December 3, 2021 Opinion or Order Filing 7 ORDER: Plaintiff has filed a Motion for Leave to Proceed in Forma Pauperis ("IFP") in this case (see Doc. #2 ), but has failed to provide the necessary prisoner trust fund account information as required by the PLRA to determine whether the inmate is entitled to proceed without prepaying fees and costs. Pursuant to 28 U.S.C. Section 1915(b)(1), the Court must review the prisoner trust fund account statement for the 6 month period immediately preceding the filing of this action. IT IS THEREFORE ORDERED that Plaintiff shall provide the Clerk of Court with the attached certification completed by the Trust Fund Officer at the facility and a copy of his/her trust fund account statement (or institutional equivalent) for the period 10/19/2021 to 12/2/2021 no later than 45 days from the date of this order. Failure to do so will result in dismissal of this action for failure to comply with an Order of this Court. Fed. R. Civ. P. 41(b). See generally Ladien v.
