ORDER: Petitioner, Mark Alan Lane, has filed a pro se Petition for Writ of Habeas Corpus to correct his sentence under 28 U.S.C. 2241. Without commenting on the merits of Petitioner's claims, the Court concludes that the petition survives preliminary review under Rule 4. Consequently, the Government is DIRECTED to file a response to the petition within THIRTY (30) days of this Order, or March 11, 2022. The Government shall, as part of its response, attach all relevant portions of the record. After the Government files its response, Petitioner will have THIRTY (30) days, or until April 11, 2022, to file a reply. If review of the briefs indicates that an evidentiary hearing is warranted, the Court will immediately set the hearing by separate notice. NOTICE AND ORDER: The Court has received your Petition for Writ of Habeas Corpus. Your case number is 21-1692-SMY. Within 30 days of the entry of this Order, you are ORDERED to submit the $5.00 filing fee or a motion to proceed without prepayment of the filing fee. If you file a motion to proceed without prepayment of the filing fee, the Court must review your trust fund account statement for the six-month period immediately preceding the filing of this action. Thus, you must have the Trust Fund Officer at your facility complete the attached certification and provide a copy of your trust fund account statement (or institutional equivalent). If you fail to pay the filing fee or submit the motion to proceed without prepayment of the filing fee by the deadline, the case will be dismissed without prejudice for failure to prosecute. FED. R.
