January 18, 2022 Opinion or Order Filing 5 ORDER: Under 42 U.S.C. 405(g), "Any individual, after any final decision of the Commissioner of Social Security made after a hearing to which he was a party, irrespective of the amount in controversy, may obtain a review of such decision by a civil action commenced within sixty days after the mailing to him of notice of such decision or within such further time as the Commissioner of Social Security may allow." The Commissioner of Social Security accepted Diana Bowles as a substitute party for Mark S. Bowles after he passed away in 2018 during the pendency of the underlying administrative proceeding. Diana Bowles, having been a party to the underlying proceeding, may obtain review of the Commissioner's final decision by this civil action, and need not move to proceed as next friend. As such, Plaintiff's Motion to Appoint Next Friend is DENIED as moot. Diana Bowles may proceed as Plaintiff to this action. Signed by Chief Judge Nancy J. Rosenstengel on 1/18/2022.
