Filing 5 JURISDICTIONAL ORDER: This matter is before the Court sua sponte on the issue of federal subject matter jurisdiction. See Foster v. Hill, 497 F.3d 695, 696-97 (7th Cir. 2007) ("It is the responsibility of a court to make an independent evaluation of whether subject matter jurisdiction exists in every case."). Plaintiff Tarpley has filed a Complaint (Doc. 1), asserting that this Court has jurisdiction pursuant to 28 U.S.C. 1332, the diversity statute. However, the amount in controversy must exceed "$75,000, exclusive of interest and costs" for the Court to have diversity jurisdiction over the case. 28 U.S.C. 1332 (emphasis added). Here, the Complaint alleges that "[t]he amount in controversy exceeds $75,000.00 and thus jurisdiction is based on diversity."(Doc. 1, p. 1). Plaintiff must amend to properly allege diversity. The Amended Complaint shall be filed no later than March 11, 2022. If Plaintiff fails to file an Amended Complaint in the manner and time prescribed or if, after reviewing it, the Court finds that Plaintiff does not properly establish subject matter jurisdiction, the Court may dismiss the action for lack of jurisdiction.
