April 26, 2022 Opinion or Order Filing 4 ORDER TRANSFERRING CASE TO OTHER DISTRICT: Case transferred to the United States District Court for the Central District of Illinois. On 4/25/2022, Plaintiff filed a notice of lawsuit (Doc. 1) which the Court construed as a Complaint. The Complaint does not include a statement of claim and only sets forth a request for relief. Plaintiff seeks monetary relief for false arrest and imprisonment. Although the filing could not stand on its own as a formal Complaint, Plaintiff attempts to sue the states attorney of McClean County, Illinois, which is located in the Central District. Plaintiff is also currently incarcerated at Stateville Correctional Center, which is located in the Northern District. Thus, the case was improperly filed in this district. 28 U.S.C. 1391(b). Venue is proper in the Central District where McClean County is located and a substantial part of the events or omissions giving rise to Plaintiff's claims occurred. Id. See also 28 U.S.C. 93(b). Thus, pursuant to 28 U.S.C. 1391(b) and 1404(a) and on the Court's own motion, IT IS THEREFORE ORDERED that this action is TRANSFERRED to the United States District Court for the Central District of Illinois for such further proceedings as that Court may deem appropriate. April 25, 2022 Opinion or Order Filing 3 NOTICE AND ORDER: The Court has received your Complaint. Your case number is 22-825-NJR. Within 30 days of the entry of this Order, you are ORDERED to submit the $402.00 filing fee or a motion to proceed without prepayment of the filing fee. If you file a motion to proceed without prepayment of the filing fee, the Court must review your trust fund account statement for the six-month period immediately preceding the filing of this action. Thus, you must have the Trust Fund Officer at your facility complete the attached certification and provide a copy of your trust fund account statement (or institutional equivalent). If you fail to pay the filing fee or submit the motion to proceed without prepayment of the filing fee by the deadline, the case will be dismissed without prejudice for failure to prosecute. FED. R.
