Date Filed Document Text
June 23, 2022 Set/Reset Deadlines: Amended Pleadings due by 7/21/2022. (kare)
June 22, 2022 Opinion or Order Filing 10 ORDER: Plaintiff missed the deadline for filing a proper complaint and paying the $402.00 filing fee or submitting a motion for leave to proceed in forma pauperis (IFP motion) on June 10, 2022. He has since filed a notice of change of address and confirmed his plans to proceed with this action. Plaintiff cannot proceed, however, until he files a proper complaint and either prepays the full filing and docketing fee of $402.00 or submits an IFP motion, consistent with the instructions in the Order at Doc. 4. Given his recent relocation, the Court will give Plaintiff more time to do so. The Court hereby EXTENDS the deadline to JULY 21, 2022. He is WARNED that failure to submit a complaint, filing fee, and/or IFP motion by this extended deadline shall result in dismissal of the action for failure to comply with an order of this court. Fed. R. Civ. P. 41. The Clerk's Office is DIRECTED to SEND Plaintiff a copy of the court's standard civil rights complaint form, IFP motion, and Order at Doc. 4, along with a copy of this Order. Signed by Judge J. Phil Gilbert on 6/22/2022. (jsy) THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED.

May 13, 2022 Opinion or Order Filing 4 ORDER: This case was opened upon receipt of a document from Plaintiff Walker complaining about the conditions of his confinement at the United States Penitentiary located in Coleman, Florida (USP-Coleman II). (Doc. 1). Walker states that he "wants to file a class action" lawsuit. See Id. It is unclear whether Walker intended the document to serve as his complaint in a newly-opened suit or whether he was simply requesting the forms necessary to commence a lawsuit in this or another federal court. Walker also filed the document without paying a $402 filing fee for this action or a motion for leave to proceed in forma pauperis (IFP motion). In order to proceed any further, Walker is ORDERED to FILE a proper complaint naming the plaintiff(s) and defendant(s), setting forth his claims against each defendant, and including a request for relief. Plaintiff(s) must also prepay the $402 filing fee or file a motion for leave to proceed in forma pauperis. Walker's complaint and IFP motion are due on or before JUNE 10, 2022. He is WARNED that failure to file a proper complaint and either prepay the $402 filing fee or file an IFP motion shall result in dismissal of this case with an ongoing obligation to pay the full filing fee for it. If he does not intend to proceed with this lawsuit, Walker should simply request voluntary dismissal of this action by the same deadline, and his timely written request will result in dismissal of the action without prejudice and without a filing fee. The Court hereby DEFERS all further screening of this matter under 28 U.S.C. 1915A until after this deadline expires. The Clerk's Office is DIRECTED to SEND Walker a blank civil rights complaint form and blank IFP motion along with a copy of this Order. Signed by Judge J. Phil Gilbert on 5/13/2022. (jsy) THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED.

Consent/Non-Consent to U.S. Magistrate Judge Jurisdiction form sent to Plaintiff on 05/12/2022. Consent due by 6/1/2022 (kare)
