July 6, 2022 Opinion or Order Filing 13 ORDER denying #12 Motion for Copies. Plaintiff has filed a second motion asking the Court to send him a copy of his Complaint and exhibits in order for him to determine if any documents were misplaced. He received grievances and request slips from the Dixon mailroom, and he believes that these documents must have fallen out of envelope sent to the Court. Plaintiff states that he is indigent and cannot afford the copying fees. As Plaintiff has been advised, copies of court documents are available at a cost of $.50 per page, which must be prepaid. See 28 U.S.C. Sec. 1914(b). This rule applies even to plaintiffs who are indigent. See Hoffman v. Hertz, No. 15-cv-00289-MJR, 2015 WL 1598078 at *2 (S.D. Ill. Apr. 8, 2015).The fee for one copy of the 354-page complaint is $177.00. Upon receipt of this payment, the requested copies shall be mailed to Plaintiff via regular mail. Signed by Judge Stephen P. June 30, 2022 Opinion or Order Filing 11 ORDER: Plaintiff has filed a "motion in regards to proper documents (all) being enclosed in this complaint." (Doc. #6 ). He asks the Court to let the record reflect that Plaintiff is having issues with his mail and does not "understand what is going on." The #6 motion is DENIED. Plaintiff does not specify what issues he is having regarding mailing documents to the Court, and he has successfully mailed a 354 page Complaint, including exhibits, and four motions. No Court action is needed at this time. Plaintiff has also filed a motion requesting copies of his "entire law suit." (Doc. #8 ). The #8 motion is DENIED. As a general rule, the District Clerk will only mail paper copies of documents upon prepayment of the required fee of $0.50 per page. If Plaintiff desires copies of any of the pleadings in this civil case, he may file another motion for copies of the documents by title and document number, along with prepayment of the $0.50 per page copying fee. Plaintiff's in forma pauperis status does not entitle him to free copies of documents from the Court's docket. See Lucien v. DeTella, 141 F.3d 773, 774 (7th Cir. 1998). In light of this Order, the #10 motion for status regarding copies is DENIED. The Clerk of Court is DIRECTED to send Plaintiff a copy of the docket sheet. Signed by Judge Stephen P. June 1, 2022 Opinion or Order Filing 7 ORDER GRANTING Plaintiff's motion to proceed in forma pauperis ("IFP") (Doc. #2 ). Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $29.53. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court upon receipt of this Order. Plaintiff shall make monthly payments of 20% of the preceding month's income credited to Plaintiff's prison trust fund account (including all deposits to the inmate account from any source) until the $350.00 filing fee is paid in full. The agency having custody of Plaintiff shall forward payments from Plaintiff's account to the Clerk of this Court each time the amount in the account exceeds $10 until the $350.00 filing fee is paid.In addition, Plaintiff shall note that the filing fees for multiple cases cumulate. See Newlin v. Helman, 123 F.3d 429, 436 (7th Cir. 1997), overruled in part on other grounds by Lee v. Clinton, 209 F.3d 1025 (7th Cir. 2000); Walker v. O'Brien, 216 F.3d 626 (7th Cir. 2000). A prisoner who files one suit must remit 20% of his monthly income to the Clerk of the Court until his fees have been paid; a prisoner who files a second suit or an appeal must remit 40%; and so on. Newlin, 123 F.3d at 436. "Five suits or appeals mean that the prisoner's entire monthly income must be turned over to the court until the fees have been paid." Id. Payments shall be mailed to: Clerk of the Court, United States District Court for the Southern District of Illinois, 750 Missouri Avenue, East St. Louis, Illinois 62201. The Clerk is DIRECTED to send a copy of this Order to the Trust Fund Officer at the Dixon Correctional Center upon entry of this Order. Signed by Judge Stephen P. McGlynn on 6/1/2022.
