June 10, 2022 Opinion or Order Filing 5 ORDER TO SHOW CAUSE. Plaintiff Bass has filed a Complaint (Doc. 1) predicated upon employment discrimination against his employer, UPRC, which purportedly was located in St. Louis, Missouri. Within the Complaint, Bass asserts, "Venue is proper pursuant to 28 U.S.C. 1391(b)(1) and (b)(2), as the actions complained of took place in the judicial district and Defendant is present and regularly conducts affairs in this judicial district; as well as through 42 U.S.C. 2000e 5(f)(3) in that the Southern District of Illinois is a judicial district in the state of Illinois in which the unlawful employment practices are alleged to have been committed." Upon review of the complaint, the Southern District of Illinois may not be the appropriate venue for further litigation. According to 42 U.S.C. 2000e, Title VII claims may properly be brought in any judicial district in which: (1) the unlawful employment practice is alleged to have been committed; (2) the employment records relevant to such practice are maintained and administered, or (3) the aggrieved person would have worked but for the alleged unlawful employment practice. Rather than sua sponte transferring this action in its entirety pursuant to 28 U.S.C. 1404, the Court will allow Bass to SHOW CAUSE in writing on or before July 1, 2022, why this action should not be transferred.
